The health crisis in Belgium: A breeding ground for indirect discrimination?

Avocats Sans Frontières publishes a study on the indirectly discriminatory impact of Belgian emergency policies on certain categories of the population, particularly vulnerable ones. The analysis, carried out as part of the project ‘Covid-19 Monitoring and Rule of Law’, relies on observation activities, as well as a set of interviews conducted by ASF in June and July 2020.

Ebru Timtik est morte, sauvons Aytaç Unsal

Les avocats Ebru Timtik et Aytaç Unsal, condamnés à respectivement 14 ans et 11 années de prison, ont décidé de faire une grève de la faim illimitée pour dénoncer le procès injuste dont plusieurs dizaines d’avocats turcs font l’objet. Ils demandent à pouvoir bénéficier d’un procès équitable. Ce jeudi 27 août 2020, nous avons appris avec une peine immense le décès de Ebru Timtik, en grève de la faim depuis 238 jours. Aytaç Unsal est toujours en grève de la faim aujourd’hui et sa libération pour raisons de santé a déjà été rejetée. Nous demandons la libération immédiate de Aytaç Unsal, afin qu’il ne subisse pas le même sort qu’Ebru Timtik. Nous demandons également le respect, sans délai, du droit à un procès équitable, garanti par l’article 6 de la Convention européenne des droits de l’homme à laquelle la Turquie est partie.

Tunisia : The Truth and Dignity Commission report available in English !

On July 24th 2020, the Truth and Dignity Commission’s (IVD) final report has finally been published in a special issue of the Official Gazette of the Tunisian Republic. This report concludes the Commission’s work, which included the hearings of nearly 62.000 victims, the transfer of 204 cases to specialized criminal chambers in charge of prosecuting the perpetrators of human rights’ violations and economic crimes.

Truth and Reconciliation Commission: Belgium’s opportunity to deal with the injustices born of its colonial past

The issue of prejudices born out of colonisation, which has long been relegated to the background of public discourse, has recently gained momentum in Europe; particularly in Belgium.

A proposal for a Truth and Reconciliation Commission is currently being debated by Belgian parliamentarians. Belgium thus has a historic opportunity to confront its colonial past, to address the underlying roots of the contemporary injustices faced by its Afro-descendant population and to establish new relationships with the formerly colonised societies.

Au vu des circonstances exceptionnelles qui touchent l’ensemble de la planète, dues à la menace grave et imminente que représente la « pandémie COVID19 » pour la santé et la vie humaines, et sur la base des diverses mesures de prévention prônées par l’Organisation Mondiale de la Santé (OMS) et adoptées par de nombreux pays pour en endiguer la propagation (procédures visant à réduire les contacts humains, mesures de mise en quarantaine ou de confinement, etc),.. Joint statement on the situation of refugees in Greece

The signatories strongly condemn all violation of human rights of those seeking asylum in the European Union. On no account does the protection of the EU’s external borders exempt EU Member States from their obligations under European law. None of the current Greek practices of suspending registration of asylum applications, pushing back refugees arriving from Turkey, deporting refugees back to their countries of origin or countries of transit where they will face continued persecution or containing refugees in overcrowded camps without access to basic needs and access to law, are compatible with international and European laws on human rights.

Keys for access to justice in the Central African Republic

Access to justice is a serious problem in the Central African Republic. That is the key finding in a study Avocats sans Frontières has just published. Analysis of the situation on the ground has revealed difficulties in access to lawyers and to a state justice system of adequate quality. Those are the reasons why citizens avoid the formal state system, and instead, turn to local chiefs, religious leaders, non governmental organisations and others. ASF recommends that development agencies draft and implement robust strategies to achieve sustainable improvements. And for them to be successful, these strategies must include all the actors involved, both formal and informal.

CAR/ICC: 18 years imprisonment for J-P. Bemba

The International Criminal Court sentences the former leader of the Movement for the Liberation of Congo, Jean-Pierre Bemba to 18 years’ imprisonment for war crimes and crimes against humanity committed by his troops in the Central African Republic in 2002-2003. ASF supports the prosecution of other perpetrators of serious crimes committed in CAR, including through the effective establishment of the Special Criminal Court.
