New study published by ASF

We are pleased to present the new study published by Avocats Sans Frontières,  titled « Etude de Jurisprudence : L’application du Statut de Rome de la Cour Pénale Internationale par les juridictions de la République Démocratique du Congo ». The study builds on a detailed examination of the decisions of the Congolese military tribunals, the relevant national laws, the Rome Statute and the Rules of Procedure and Evidence as well as general principles of international criminal law and the jurisprudence of international criminal tribunals.

ASF is present in the DRC since 2002, and in 2005, the organisation implemented a vast program focusing on the fight against impunity for international crimes. Within the context of this program, ASF has provided legal assistance to victims and/or alleged perpetrators appearing before the Congolese courts.

ASF decided to carry out the present study in order to contribute towards a greater understanding of the law and the practice in the DRC in relation to the investigation and prosecution of international crimes and the challenges and difficulties to which the judges are confronted in dealing with such crimes. This study presently exists in French only; however ASF hopes to have an English version available soon.
